These Terms of Service ("Terms") govern your access to and use of Widgets by Olutely (the "App"), which is made available within the ChatGPT experience. The App is provided by Spheric Admin Ltd ("Provider," "we," "us," or "our"), not by OpenAI.

By using the App, you agree to these Terms. If you do not agree, do not use the App.

1) Definitions

• "App" means Widgets by Olutely, including its interactive UI elements and features shown inside ChatGPT.
• "Platform" means ChatGPT and related services operated by OpenAI.
• "User" means the person using the App ("you").
• "User Content" means the content you provide to the App within ChatGPT (for example: messages, inputs, selections, and instructions directed to the App).
• "Output" means content or UI responses the App returns inside ChatGPT.

2) Relationship to OpenAI and the Platform

1. Platform terms apply. Your use of ChatGPT is governed by OpenAI's terms and policies.
2. Independent provider. The App is provided by Spheric Admin Ltd. OpenAI is not responsible for the App or Provider's services.
3. Priority. These Terms apply to the App. OpenAI's terms apply to the Platform. If there is a conflict about the Platform itself, OpenAI's terms control.

3) Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent you have permission from a parent or legal guardian to use the App.

4) What the App Does

The App provides enhancement and interactivity to conversations in ChatGPT, including user interface components and basic interactive behavior presented within the chat flow.

5) How the App Works (MCP Server)

To render UI and provide basic interactivity, the App communicates with our own MCP server (the "Server"). In practice, this may involve transmitting limited portions of your interaction (such as the specific inputs needed to render a widget or respond to a UI action) to the Server and returning the resulting UI/response back into the chat.

6) Privacy and Data Handling

1. No storage of conversation content. We do not store User Content (including conversation text or files) on our servers.
2. Transient processing. User Content may be processed transiently on the Server solely to render UI and provide basic interactivity.
3. Operational data. We may collect and retain minimal technical data necessary to operate and secure the App (for example, timestamps, request metadata, and error logs), and we aim to avoid logging conversation content. If we ever need to temporarily capture content to diagnose an issue, we will do so only to the extent necessary and for the shortest time practical.
4. Your responsibilities. Do not provide content you do not have the right to share. Do not provide sensitive personal data unless necessary for your intended use.

7) Acceptable Use

You agree not to use (or attempt to use) the App to:

• violate any law or regulation;
• violate OpenAI/Platform rules applicable to apps;
• infringe intellectual property, privacy, or other rights;
• harass, abuse, or harm others;
• introduce malware, attempt to disrupt the Server, overload the App, or bypass security;
• reverse engineer, probe, scan, or attempt unauthorized access to the Server or related systems.

We may suspend or terminate access to the App if we reasonably believe you have violated these Terms or your use poses security or legal risk.

8) Intellectual Property

1. Our IP. The App (including its UI components, branding, and underlying software) is owned by Provider and its licensors.
2. License to you. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App through the Platform for lawful personal or internal business use.
3. Feedback. If you provide feedback, you grant us the right to use it without restriction or compensation.

9) Output and Disclaimers

1. No guarantees. The App and Output are provided "as is" and "as available." Output may be inaccurate, incomplete, or unsuitable for your purpose.
2. Not professional advice. The App does not provide legal, medical, financial, or other professional advice. You are responsible for verifying information and decisions.
3. Availability. The App may be modified, interrupted, or unavailable due to maintenance, technical issues, or Platform changes.

10) Fees

The App is currently provided free of charge.

11) Suspension and Termination

• You may stop using the App at any time.
• We may suspend or terminate your access immediately if you breach these Terms, if required by law, or to protect the security and integrity of the App or Server.
• Upon termination, the license granted in Section 8 ends.

12) Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot be excluded under UK law, including liability for:

• death or personal injury caused by negligence;
• fraud or fraudulent misrepresentation.

Subject to the above, to the maximum extent permitted by law:

1. We will not be liable for indirect or consequential loss, loss of profits, loss of revenue, loss of business, loss of goodwill, or loss of data.
2. Our total liability for all claims relating to the App will not exceed GBP 100.

13) Indemnity (Business Use)

If you use the App on behalf of a business, you agree to indemnify and hold harmless Provider from claims arising out of your use of the App, your breach of these Terms, or your violation of law or third-party rights.

14) Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice within the App or by other reasonable means. Continued use after the effective date of updated Terms constitutes acceptance.

15) Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction over disputes arising out of or relating to these Terms, except where mandatory consumer protections provide otherwise.
